NOTICE: The Board of Directors Executive meetings will now be held before the OPEN meetings. The Executive (Closed) will begin at 6:00 PM, and the OPEN meeting will follow. It is difficult to gauge the time length of the Executive (Closed) meeting but the Board will work to limit the time to thirty minutes. Tentatively, the OPEN meeting should start at 6:30 PM.
The Board is not trying to make things difficult for itself and our members. Having the Executive (Closed) meeting before the OPEN meeting comes from a recent Arizona court decision and the decision has prompted the Arizona State Legislature to codify in a bill. The bill is currently on the Governor's desk and if signed will become law in September 2026. Right now it is considered Case Law and all Arizona Homeowner Associations must comply.
Topics in the Executive (Closed) meeting are regulated by ARS 33-1804 (A1 - A5). To paraphrase those topics are: Legal matters, pending litigation, contemplation of litigation; Personal, financial, health issue of an individual; Job performance; Member appeal.
The above topics for Executive (Closed) meetings are still in place. What has changed is that any votes taken by the Board regarding topics discussed in the Executive(Closed) meeting will now be in the OPEN meeting. What does this mean? For example: If the Board discussed implementing legal action against a homeowner in the Executive (Closed) meeting, the vote to do so will be in the OPEN meeting.
